These terms are between you and [TBD: legal entity] ("we"), and they apply when you use the Almanac app. If you do not accept them, do not use the app.

What this is, and what it is not

Almanac draws a Chinese four-pillars chart and a western natal chart from one birth moment, and writes about what they say — separately, and where they disagree, it says that too. It is a structured way of thinking about yourself.

It is not advice. Nothing the app writes is medical, psychological, legal, financial or professional advice, and it must not be used as a substitute for any of them. It cannot diagnose anything, it cannot predict what will happen to you, and it does not know your circumstances. If you are making a decision that matters — about your health, your money, your safety or your relationships — the app is not a party to it.

If you are in distress, please contact a local emergency service or a crisis line. The app will show you one if what you write suggests you need it, but it is not a crisis service and it is not monitored by anyone.

The app deliberately does not adjudicate. It will not tell you whether a relationship should continue, whether a chart is good or bad, or how a life will turn out. Where a reading declines to answer something, that is the product working as designed rather than a fault.

Age

You must be at least [TBD: 16, or whatever you set in App Store Connect] years old to use the app.

Your account and your data

There is no sign-up. The app creates an anonymous identity on your device the first time it runs, and that identity is how your charts are reached.

It cannot be recovered. If you lose the device, or use "Forget this device", or wipe the phone without a backup, the charts are no longer reachable and we have no way to return them to you — the identity is the only link, and we hold nothing else that could identify you. This is a consequence of not asking you to register, and it is a trade we have made deliberately; you should know about it before it matters.

Subscriptions

The chart, the pillars, the luck timeline and everything already written for you are free, and stay free.

Written readings, conversations and comparisons between charts have a monthly allowance. A subscription removes it. The allowance counts what is written, not what is read: re-reading something already written costs nothing, now or after a subscription ends.

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
• You can manage and cancel subscriptions in your App Store account settings.
• Prices are shown in the app before purchase, in your own currency, and may differ by region.
• Refunds are handled by Apple under Apple's policies, not by us.

What you may and may not do

Use the app for yourself and for people whose birth details you may reasonably enter — casting a chart for a partner, a parent or a friend is exactly what it is for. Do not enter other people's birth details in order to publish conclusions about them without their knowledge.

Do not attempt to break, overload, reverse-engineer or resell the service, use it to generate content for another product, or use it to make decisions about other people that affect their employment, credit, housing, insurance or legal standing. It is not fit for any of that, and using it that way is prohibited.

The writing

Readings written for you are yours to keep, quote and share. We keep the right to the app, the engine, the interpretive material and the software.

Readings are produced by a language model working from a deterministic chart. They will not always be right, two readings of the same chart may emphasise different things, and the app makes no promise that any statement in a reading is true of you. Where accuracy claims can be made at all, they are about the chart's arithmetic — positions, pillars, dates — and not about the writing.

Availability

We may change, suspend or stop parts of the service. If we stop it entirely, we will give reasonable notice and a way to export what you have.

Disclaimer and liability

The app is provided as it is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, or for any decision you make in reliance on a reading. Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.

Apple

You and we acknowledge that:

• These terms are between you and us only. Apple is not a party to them.
• We, and not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, and not Apple, are responsible for addressing any claim relating to the app, including product liability, any failure to conform to legal requirements, and claims arising under consumer protection or similar law.
• We, and not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

Governing law
